The Impunity of the Pro-Noynoy SWS Survey

HOW is it possible that, no matter that the current occupant in Malacanang is the son of Mama Cory and Papa Ninoy, he was able to get an amazing 88% trust rating amidst the HOCUS PCOS brand of poll fraud hoopla? According to the Social Weather Stations, Noynoy Aquino got "88% of adult Filipinos have much trust and 4% have little trust in Benigno "Noynoy" Aquino III, for a very good net trust rating of +83." Why, that's even much higher than the peak satisfaction ratings of former President Corazon Aquino at around 72%, and Joseph Estrada who got 67% at his best rating. It is so unbelievable how Noynoy, a zero-zero-bill solon from Congress to Senate and thus, virtually with no public service achievement whatsoever, be able to top the survey ratings of the two former Presidents.

Consider that the late President Aquino came out of the euphoria of the 1986 EDSA "People Power" Revolution while President Erap won with the highest plurality margin in Philippine history. And below 80% and 70% were all they got. Consider as well that Noynoy has a host of issues a thousand times worse than his mother had when she first assumed the presidency. Just about the only criticism the pro-Marcos camp was well able to hurl at Cory was her "plain housewife" naivety, which was not to say that was uneducated because she did graduate with a degree in French. Noynoy, on the other hand, was beset with a host of unpalatable issues: SCTEx corruption, Hacienda Luisita massacre and failure to implement land reform, his 2005 vote against the playing of the "Hello Garci" wiretapped evidence of the 2004 poll fraud, and 'abnormal mind' issues.


The abnormal or autistic issue was particularly nasty and dogs him to this day. The camp of presidential candidate Manny Villar played a good part in exposing it but the Nacionalista Party was definitely not alone in making it a huge electoral issue. There have been whispers of the supposed abnormal or "abnoy" state of Noynoy, with The Daily Tribune's Demaree J. B. Raval advising the Liberal Party to stop making "a limp denial of the autism issue" as early as February this year.

When it became a full-blow issue several weeks later, no thanks to Villar, the issue sounded credible to many Filipinos because, after all, autism seems to run in the Aquino family as evidenced by Noynoy's nephew by sister Kris Aquino. So shocking, or nasty, were the abnoy stories that filled not the mainstream yellow media but the alternate media, such as the internet and SMS messaging, aside from the usual word-of-mouth whispers. Essentially, the stories included talks of the late Sen. Ninoy Aquino having brought his son to a psychiatrist in Boston; that Noynoy sought psychiatric help somewhere in Ateneo; and that he smokes marijuana, a supposed cure for autism. Nastier, detailed stories, such as one narrated in a video, tell of his supposed fits and weird behavior in Ateneo that included his hiding behind stacks of books not in the library but in the cafeteria and loudly ordering fellow students to keep quiet.

However, amidst the publicly made pressures for him to show his saneness or psychological capacity to seek the presidency, he had inexplicably and adamantly refused to undergo psychological testing --while virtually all the rest of the presidentiables were willing. The result is that a good number of people tag Noynoy as psychologically challenged. Noynoy's state of mind is such a hot item that the issue is all over the internet even up to this day.

I did a quick Google search with the key words [abnoy "noynoy aquino"] around two weeks ago and came up with 57,600 hits. I did the same with an English variant, [abnormal "noynoy aquino] and got 14,100 page results. Today, I decided to Google the same words and guess what? There's INCREASED interest, with the first key phrase earning an estimated 65,700 hits, representing around 14% increase; and for [abnormal "noynoy aquino], got 16,800, which reflects around 19% greater interest in the issue. Additionally, I also Google searched [autistic "noynoy aquino"] and came up with about 20,200 results.

In short, Noynoy's stubborn refusal to prove his mental health by not undergoing psychological test appears to have rendered him mentally challenged by default in the eyes of many. This means that no matter that a pro-Cory euphoria supposedly hit the Filipinos when she died in August last year, the event could not have sustained a sentiment favorable towards trusting Noynoy, the good-for-nothing-solon son of Cory.

In fact, it remains doubtful that the pro-Cory euphoria even effectively translated into an electoral vote for the psychologically-challenged-by-default son. Take note that Noynoy run against, among others, the still very popular Erap Estrada to whom Cory apologized in December 2009 for her role in the 2001 EDSA. In apparent respect and gratitude, Erap called on his legions of masa supporters to show respect for Cory when the latter died. Who's to exactly tell then that the Cory sympathizers following her death even liked Noynoy? I myself was in Cory's funeral but there was no way I voted Noynoy last presidential elections.

Improbable Statistics

I've warned of cheating prior to the May 10, 2010 elections because based on the Illegitimate President' shistory and litany of corruption scandals, it would be impossible for her to step down without a an evil scheme for self-presevation or self-interest. It would be natural of Arrobo to seek and forge an unholy deal with a ‘friendly’ presidentiable who would look after her when she steps down. Of the three candidates known or rumored to be the Illegitimate President's bet, I suspected it would be the obvious, administration candidate Gilbert "Gibo" Teodoro. I was wrong.

Initially described as "refreshing" in terms of the speed of results, and even "orderly and honest" by the yellow media, the unraveling of what has been described as "automated Garci," in reference to the 2004 presidential poll fraud will begin with the gross mismatch between field pulse and AES statistics Comele gave to the "defeated" presidential candidates. Later on, the sheer statistical improbability of votes received by the presidentiables, losing and "winning," will strike the mind.

Without even considering the AES technicalities and legalities, it was actually the highly improbable election statistics given by Comelec triggered the initial suspicions that something was woefully not right with the automated polls. De los Reyes well illustrates this when he retracted his early concession to Benigno Simeon Cojuangco Aquino III upon learning that he only got a measly 11,894 votes in his hometown of Nasugbu, Batangas and a statistically impossible national total of some 44,240 votes. He says his hometown votes was "Too small even, considering the excitement my candidacy generated; [when] everyone get out to campaign."

On my part, how it dawned on me that the Filipino electorate had been conned by Gloria Arroyo's government into accepting a fraudulent AES "winner" was when early broadcast results on the night of May 10, 2010 showed Joseph Erap Estrada impossibly behind Aquino in the former's bailiwicks of TONDO and SAN JUAN CITY in Manila. It was beyond any objective comprehension how the deposed President could possibly lose in those areas that have through the years consistently been solid, if not die-hard, Erap turfs.

When what is on the ground and compromised automation does not match, which do you believe? Pictures and actual sight of warm bodies say a thousand words and the "di malaglagan ng karayom" character of Estrada's rallies in the said spots, as in a good number of Pwersa ng Masa rallies and motorcades elsewhere in the country, defy the HOCUS PCOS results. Snapshots of rallies show the strength of some of the candidates and betray the apparent falsity of the Comelec figures.

In the case of Bro. Eddie's party, supporters early on claimed "under oath that in the precincts where they voted, the election results show a much lesser number of votes obtained by Bangon Pilipinas candidates than the actual number of votes cast in their favor." Moreover, the total votes the evangelist supposedly received was only 1.26 million votes. This, when during the Bangon Pilipinas Youth Rally in Luneta, crowd estimate was already placed at 1.2 million.

Simply Impossible

In a number of clustered precincts in Montalban, Rizal, the AES gave amazing results. Therein, Aquino generally got more or less 99.9% of all votes, with all the other presidentiables registering ZERO votes, with the DISQUALIFIED candidate, Acosta, garnering 2 or so votes.

There were also many clustered precincts in Dapitan City, Zamboanga del Norte and Gutalac where disqualified candidate Acosta received more votes than the other more popular candidates, including Estrada whom the Comelec says placed 2nd place to Aquino.

The incredible, statistically improbable pattern of Noynoy Aquino practically garnering all votes, with most of the other candidates even getting zero, is repeated in many clustered precincts in Sultan Kudarat. While there were precincts where Nacionalista Party standard-bearer Villar was able to get double digit votes, it was more a case of single digit, if not zero for him and all the other candidates, including Estrada and supposed administration candidate Teodoro.

Moreover, there were even instances when, similar to the Montalban areas, disqualified candidate Acosta got 1 or 2 votes while others like Erap and Madrigal got ZERO again. Madrigal, the feisty and nationalist-inclined former lawmaker, it should be noted, placed fourth during the 2004 senatorial elections, garnering some 13M votes. So amazingly unbelievable is the presidential tally in the Philippines' first automated polls, with Acosta receiving more votes than the combined figures of Madrigal, Perlas, and de los Reyes in the final AES nationwide tally.


Which brings us to the most serious issue against Noynoy's "presidency"--the credibility and legitimacy of the 2010 automated elections and, therefore, whether he has the mandate at all to occupy Malacanang.

Apart from the considerations of AES technicalities, perhaps the most convincing argument to believe that poll fraud did occur in the recent polls is the fact that the most beprincipled and most result-disinterested of the presidential candidates have cried HOCUS PCOS cheating and, moreover, embarked on a campaign to unmask the truth of the May 2010 elections. I refer to Sen. Jamby Madrigal, Mr. Nikki Perlas and Councilor Jc de los Reyes. These three honorable candidates have expressly admitted several times that they already consider themselves losers in the elections; yet, they are active in the campaign to inform the public of the illegality and failure of the AES that the Commission on Elections implemented. That is not to say that Bro. Eddie Villanueva, who is also part of the MIGHT e2010 coalition of 'truth seekers,' is not equally highly principled and even moral; however, because he has been described by some to be the real second-placer in the 2004 polls to FERNANDO POE JR, and NOT Gloria Arroyo, the former could have a greater interest in the results of the recent presidential race.

As for the technicalities of the AES, the evidence indicative of poll fraud is overwhelming. As the Global Pinoy Online News Crisis of Sovereignty series says, the fraud is but commonsensical. The separate reports of the Peoples' International Observers Mission*, the independent body of GFN 2010 Election Observers Team of Global Filipino Nation (GFN), a non-partisan international organization of offshore and onshore Filipinos, Sen. Aquilino Pimentel's statement on "his vote on the proclamation of the newly-elected President and Vice President at the Session Hall of the Batasang Pambansa on June 9, 2010."

PIOM Report

The Peoples' International Observers Mission—foreign delegates made up of academicians, lawyers, law students, journalists, social workers, union organizers, church workers--came to the country as poll observers. They documented specific fraud and violence cases in some of the country’s hot spot areas during the polls and are reported to have been 'shocked by fraud, irregularities, and violence.' Radhika Sainath from the United States said that "In 10 years of monitoring elections, I've never seen this level of irregularities and fraud that I witnessed on Monday."

GFN Report

The independent body of GFN foreign observers--foreign delegates made up of academicians, lawyers, law students, journalists, social workers, union organizers, church workers--also documented specific fraud and violence cases in some of the country’s hot spot areas during the polls. This group came up with a more comprehensive and in-depth report.

I. The election results transmitted from the precincts do not have digital signatures of the board of election inspectors.
II. The number of disenfranchised voters is sufficient to affect greatly the results of the elections.
III. The automated election system (AES) was implemented live without the appropriate field testing, and law-specified testing in actual elections.
IV. The source code review was not completed and initial findings were not addressed.
V. No audit was done on the AES prior to the elections. There was only a mandated random manual audit that, up to this writing, has not been completed.
VI. Several voter and security features were disabled prior to the elections.

Pimentel's Explanation

Even Sen. Aquilino Pimentel, who gave his "yes" vote to the June 9, 2010 proclamation of Noynoy Aquino as "President," faulted the automated polls for leaving "a long trail of deficiencies... [which] were mostly directly machine-generated, but, at least, on one occasion, the shortcoming was specifically man-made." He added a list of missteps taken by Comelec and/or Smartmatic. The former senator regrets the following points:

1) Denial of right to know whether ballot cast was counted

The AES system last May 10, 2010 gave voters no way of knowing whether

the PCOS counted their ballots. The paper trail that the Comelec earlier promised the lawmakers did not materialize.

2) Wrong dates recorded on the certificates of canvass

The wrong time and date stamped on some Election Returns (ERs) form a tell-tale sign of possible tampering or "that something was grievously wrong" with the PCOS machines that electronically tallied and transmitted the votes to the Joint Congressional National Canvass Center

(3) On-off sensors, clearly "something was basically wrong" with certain PCOS machines

Investigation of a compact flash (CF) card of Quezon City congresswoman Annie Susano revealed the on-and-off switching of the sensors, the devices that read the ballots during processing by the PCOS machines. In simple terms, the on-off switching indicates that "some votes were counted some of the time, while others were not counted most of the time."

4) Egregious error in the Initialization Message

Meant to alert the Senate that the server in its custody could already be activated, the initialization message "had a most glaring blunder," recording the Philippine voting population at 256,733,195 or about five times more than the true figure of 51 million. Pimentel expressed bewilderment at the use of the "factor of 'five'" by the PCOS, aggravated by the "unintelligible" explanation made by Cesar Flores, the Venezuelan Smartmatic official, during the Congressional hearing.

5) Flawed Certification of the PCOS machines

The certification issued by Comelec's Technical Evaluation Committee, which was basically based on the certification of the U.S.-based Systems Lab, Inc., called for the installation of 'compensating control' devices. Unfortunately, the compensating controls that were supposed to enable a 99.995% accuracy for the PCOS machine's were not installed, said the Philippine Computer Society.

6) Arbitrary removal of security safeguards

That the canvass reports transmitted from cities and provinces were no longer accompanied by digital signatures made the determination of the COCs' due execution and authenticity by the National Canvassing Board difficult.

7) Non-use or disabling of Ultra Violet lamps

The UV lamps in the PCOS machines were meant to spot spurious ballots even before they can be inserted into the machines but the Comelec disabled this feature. Apparently, this led to the procurement of portable UV lamps to the tune of P30 million; despite the huge cost, however, Comelec did not make its use obligatory, largely leading to its non-use.

8) Relaxation of original intent for mandatory UV ink use

RA 9369, or the law authorizing AES elections, requires the use of necessary safeguards to prevent spurious ballots. In an automated electoral system, the equivalent safeguard would be like the use of UV ink complemented by the UV reader in the PCOS machine. Thus, the disengagement of the UV lamps in the PCOS effected the high probability "that fake ballots were manufactured and used fraudulently and scrupulously is high."

9) Non-Audit of CF Cards

The Comelec was supposed to conduct manual audit for the positions of president, vice-president, congress member, governor, and mayor but failed to do so. This casts doubts on Comelec's sincerity and the automated polls' accuracy.

10) Non-compliance with "ladderized system" of transmission leading to legally infirm 'unofficial' results

The transmission of results is supposed to emanate from the a) PCOS in the precincts to the municipality/city consolidation and canvassing servers or MCCS;, then b)from the MCCS to the provincial/district consolidation and canvassing servers or PCCS; and c) from the PCCS to the servers of Comelec and Congressional National boards of Canvasser. This ladderized system was not followed, leading to improper consolidation of transmitted results at the election return (ER) level, from which the Comelec and PPCRV where surprisingly able to make their quick counts.

Final Forensic Report of Joint Canvassing Committee

Even the final forensic report of the Joint Congressional Canvassing Board on the PCOS machines inappropriately housed in the residence of a Smartmatic technician officially found defects and serious anomalies. The report's main points are: (1) the mismatch between the Comelec-published and the extracted hash codes; (2) absence of digital certificates in the PCOS contrary to Smartmatic's claim; the (3) the alarming presence of a secret "backdoor" to easily control PCOS operations; and (4) the CF cards in possession of Rep. Susano are authentic and duly issued by the polls body.

The authentication of Susano’s CF cards in a way validates Sen. Pimentel's report pointing to the defective ballot-reading sensors in at least a number of CF cards. As well, it also indicates the poll body's inability--deliberate or otherwise--to secure all its duly-issued CF cards. Together with the discovery of a backdoor control, absence of digital signature equivalent in the PCOS machines, and mismatched hash codes, the joint forensic report by itself already points to a very insecure AES system, even indicating a possible collusion between Comelec and Smartmatic.

Mind Boggling, but More

How mind-boggling that despite all these reports, Comelec seems to have gotten away with putting up an AES that is fundamentally defective and apparently designed to be fraudulent. It does not stop with the above four reports, however. News stories by local, non-mainstream media provide more evidence to the desecration of the people's will last May 10.

The Daily Tribune reports on the day after elections that: "In Angono, Rizal, amid reports of massive vote buying, voters will (sic) surprised to find out that in the ballots given to them, the name of the LP standard-bearer, Aquino had been already shaded." The massive disenfranchisement report by GFN is given real-life by color by the news report of how drivers eager to vote for their bets were disheartened by the demand of bus operators for drivers and transport workers not to miss even one minute of last May 10, despite the fact that Election Day was a declared a holiday. The disenfranchisement is most notable because it seems to have targeted the masa group given other reports of the names of registered squatters having been stricken off Comelec list.

An important revelation is reported by Pinoy Global Online News on the PCOS software in escrow with the Central Bank. In its interview of Nelson Celis, President of the Philippine Computer Society that assisted the IT Teams of the House, Senate and Comelec in the forensic investigation on the PCOS machines in Antipolo, the PCOS machines run programs that do not correspond to the official program in the Central Bank.

“Unelected and Illegal Government”

Perlas' scathing June 30, 2010 report entitled "Unelected and Illegal Government" sums up the evidence in the elite conspiracy for the May 10, 2010 massive fraud. He says that the subversion of Philippine democracy in the country's first automated poll fraud "dwarfs the manual cheating done by Commission on Elections (Comelec) Commissioner “Garci” in the 2004 presidential elections. He cites the many legal violations committed by the poll body, such as the dismantling of the PCOS UV security system; removal of the Voter Verification feature that should have presented a list verifying one's vote; absence of the public examination of the PCOS source code; Re-configuration of Compact Flash (CF) cards without proper oversight; and lack of clear accountability and inventory of millions of unused ballots.

He also cites highly suspicious activities conducted by Comelec, including the quiet sending of a total of 1600 CF cards and 160 "burners" that can give fraud operators the needed tools to tamper with poll results. Perlas also sketches the apparent modus operandi of fraud, based in part on Committee hearings, which are: the pre-programming of primary CF cards; pre-shading of ballots; interception of transmission; and collusion between Comelec officials and Smartmatic Technicians.

Interestingly, Perlas also explains the role of yellow media and fabricated surveys in conditioning the people into expecting "certain candidates to win." The mainstream media, including ABS CBN, Philippine Star, Philippine Daily Inquirer, and even, GMA7 reinforce this fabricated ideas through their lopsided and brainwashing reports. Even the Parish Pastoral Council for Responsible Voting (PPCRV) acted not as watchdog for the public but, rather, for the Comelec.

The defeated but beprincipled candidate also points to the legal transgressions committed by Congress owing to its inability to question the massive automated poll fraud. Worse, Congress took part in the crime by (1) failing to convene only a Joint Committee, instead of a Joint Session, to canvass the presidential and vice-presidential votes, and (2) canvassing electoral returns that contained no digital signatures. He asserts that the May 10 polls were actually invalid and void from the start, given the process's wanton violations of the law.

Sison's Pinky, Gloria and CIA Expose

There is more. A most explosive revelation from an unexpected source was yet to come. On June 7, 2010, Pinoy Weekly Online came out with an interview of Jose Maria Sison, consultant and former head of the National Democratic Front. Therein, Sison charged that the recent automated electoral exercise was rigged, with the poll "victory" of Noynoy Aquino already a done deal. He pointed to the collusion of the imperialist United States of America, Arroyo, and Pinky Aquino-Abellada, an elder sister of Noynoy, which was forged in a meeting held six weeks before the elections.

As expected, Pinky and the Aquino family denied the charge. What is worth noting is that the revelation came from someone the Yellows —the Aquino and the Arroyo families, among others-- were in tactical alliance with during the 2001 ouster of Estrada. The Arroyos and Aquinos cannot possibly just dismiss Sison as opportunist or what because they were unholy allies there in the undemocratic EDSA 2 coup against a genuinely elected and sitting President.

Desecrating Survey Research... in the name of the Yellows

So, therefore, to reiterate the highly unamusing bewilderment: how could a zero-accomplishment former congressman and senator plagued with HOCUS PCOS and abnoy/austistic labels, with no mass base of his own and who ranked only sixth out of 12 seats in the 2007 senatorial polls, possibly earn the trust of a whooping 88% of the electorate? Where did the SWS draw the simply astonishing survey results? From a HOCUS PCOS survey counterpart system?

I remember how I was sort of academically introduced into revering survey studies. Back in my college days at the University of the Philippines, I briefly attended a political science class of Prof. Felipe Miranda, now with Pulse Asia but said to be still a director of SWS. He discussed with near academic reverence the survey research process, ending it with the calling that 'next time [we] come across a survey study, we should hold it close to our heart' or something. Those words led me to revere poll studies for a long time as a science, as a tool to scientifically and honestly gauge public opinion. For a decade or so. Until the 2004 presidential polls.

In March of this year, ex-Sen. Francisco Kit Tatad reposted a 2004 article where he reveals how SWS and ABS-CBN screwed public perception of the presidential poll count by selecting Quick Count areas where Arroyo is strong and bypassing more those where the later Fernando Poe Jr. held sway. The devious intent was to set a trend that matched the SWS exit survey which showed Arroyo as the pre-electoral choice of Filipinos. In other words, the geographic distribution of the Quick Count was increased for Visayas, where Arroyo was leading, and decreased for the rest (National Capital Region, Luzon, and Mindanao).

The 2004 SWS pre-electoral survey at the national level and the exit poll for NCR both indicated Arroyo won. As official results later showed, Fernando Poe Jr. won in NCR but lost in the nationwide count. Apparently, SWS at least got its national figures right, with Arroyo having been proclaimed "President-elect" and later officially by Congress. However, the 2005 "Hello Garci" expose showing wiretapped evidence of Arroyo's collusion with Comelec and military and, indirectly, even congressional officials to manipulate the 2004 poll results effectively belie the accuracy of the SWS survey. Everyone now knows that FPJ was the rightful victor of the 2004 elections; Arroyo just cheated him. And so SWS was dead wrong on the presidential race. Wonder if SWS actually manipulated the results to make the Illegitimate appear winnable, not expecting the future Hello Garci expose on the Maguindanao portion of the ballot....

Former Sen. Madrigal has dubbed the May 10, 2010 elections as "automated Garci." Given the uncanny association, if not collusion, between the Arroyo government's holding of fraud-laden electoral exercises and survey firms, and amidst the anomalous, HOCUS-PCOS-indicative May 2010 AES, are we silly to simply accept the incredibly high 88% trust rating of Noynoy?

According to Perlas, the reason why he is not conceding despite his admission that he has lost his presidential bid is because he believes that the "accuracy and honesty of the country’s electoral process [lie at] the heart of the democratic exercise" and that "If there is to be a President in this country, he or she has to have the true mandate of the Filipino people." Noynoy Aquino, the possibly psychologically challenged, SCTEx- and Nantes-explosion-sullied, and definitively unaccomplished solon son of Ninoy and Cory does not even seem to have the genuine mandate of the Filipinos. How could he possibly have an 88% trust rating then?

If Cory, the mother, referred to by some as the "democracy icon" can only get 60% trust rating a few weeks before she died, how impossible and illogical is it for her incompetent solon of a son, who also happens to be dogged by serious mental health, corruption and even narco-politics issues, possibly score a much, much higher trust rating? Even if, for the sake of argument, the abnoy and HOCUS PCOS issues are stricken off him, it doesn't make sense that the presumed transfer of Cory's 60% trust ratings even gained 12% upon reaching Noynoy. Remember that the current yellow occupant of Malacanang scored zero accomplishment as congressman and senator; moreover he was definitely not considered of presidential timbre prior to his mother's death. What did SWS give the Filipino public this time? Another case of yellow impunity? A case of automated HOCUS PCOS SWS survey?

Pre-Hello Garci: How ABS-CBN, SWS, & NAMFREL Misled the Filipinos on the 2004 Poll Count

Because of the unduly large role being played by the polling agencies in choosing national and even local candidates, I am rerunning this article that first appeared during the 2004 presidential elections to help the reader gain a sober and intelligent perspective on the credibility of these agencies.

On May 10, 2004, after the counting of votes at the precincts, ABS-CBN began broadcasting a Quick Count. There was no attempt on the part of government to stop it. That would occur much later, when the Commission on Elections and the Department of Justice stopped ABC-Channel 5 from conducting its own count, and ordered the Daily Tribune not to carry ads containing hitherto unpublished election results supplied by the Opposition.
As of 4 a.m. of May 11, 2004, the first 1.224 million votes counted were distributed as follows:
NCR — 20.46 percent
Luzon —39.60 percent
Visayas —18.58 percent
Mindanao —21.36 percent

At this time of day, Mr. Mahar Mangahas appeared at ABS-CBN to deliver the first results of the ABS-CBN/SWS exit poll. Based on 528 NCR respondents, this poll reported the following findings, as of 2:30 a.m.
GMA ————– 31 percent
FPJ ————— 23 percent
LACSON———- 20 percent
VILLANUEVA—10 percent
ROCO————– 8 percent
NO ANSWER—– 7 percent
Notice the big difference between the Quick Count's figure and this one. Yet the votes of SWS's 528 respondents tried to reverse the impact of the 276,969 NCR voters who had put FPJ ahead of GMA by at least 30,304 votes. In the SWS survey, FPJ was now 8 percent behind.
Mangahas did not find his NCR poll conclusive. In a text message to Ms. Susan Tagle, FPJ's communications aide, received at 3:30 a.m. of May 11, 2004, Mangahas said:
"Frm Mahar: Sori 2 disappoint. She has lead, but inconclusiv sins many kept silent. Ds is ncr only. On d way to abs now. "
Despite such inconclusiveness, he submitted the results anyway.
Given the wide discrepancy between its own Quick Count and the SWS survey, ABS-CBN management did not quite know how to proceed. They could not possibly present to the public two sets of conflicting data and still claim any credibility. According to inside informants, Mr. Dong Puno could not decide, so they woke up Mr. Gaby Lopez at 5:30 a.m. But Mr. Lopez himself could see no way out either.
Someone then proposed that the Quick Count be made to support the thrust of the SWS survey, which would eventually show GMA leading FPJ nationwide. They proposed to revise the geographic distribution of the vote count, by increasing the percentage for the Visayas (where GMA was leading FPJ) and bringing down the percentage for NCR, Luzon and Mindanao (where she was trailing FPJ).
The proposed new distribution was as follows:
NCR — 18.38 percent
LUZON — 35.84 percent
VISAYAS — 26.05 percent
MINDANAO— 19.73 percent
This proposal was accepted, and Mr. Lopez immediately left for the United States.
At 7:18 a.m. same day, the Quick Count showed the following results:

Just by readjusting the geographic distribution of the count, GMA was able to wipe out her deficit of 22,903 votes at the 4 a.m. report, and post a lead of 24,051 votes at the 7:18 a.m. count. This tends to show that GMA had posted an additional 46,954 votes while FPJ posted zero. In reality, neither the votes nor the margins in NCR, Luzon, Visayas and Mindanao changed; only the percentage distribution of the votes did. Perception of reality changed, but not reality itself.
As of 7:18 a.m. of May 11, the Quick Count had counted a total 1,613,981 actual votes for all the presidential candidates. In this count, FPJ led GMA in NCR, Luzon, and Mindanao. The only place where GMA led FPJ was the Visayas whose percentage share of the count had been changed, from 18.58 to 26.05 percent.
At 1:00 p.m. of the same day, however, the SWS exit poll, using a base of 4,627 respondents, reported the following results:

Notice that GMA now leads FJP everywhere, except Luzon.
This trend has since migrated to the Namfrel count.
Namfrel has clearly adopted the same formula used by ABS-CBN and SWS. Simply by concentrating its Quick Count on areas where GMA has more votes than FPJ, while delaying the count in bigger areas where FPJ is leading GMA by wide margins, it is able to show GMA leading FPJ across the nation.
Thus, as of 4 p.m., May 17, Namfrel already counted 1.68 million or 51.13 percent of the 3.29 million votes of Region VII, while counting only 1.19 million of Metro Manila's 6.9 million votes, and an average of 22.12 percent for the other regions..
In Central Luzon, where FPJ's advantage was never disputed, except in Mrs. Arroyo's home province of Pampanga, the same Namfrel report showed Mrs. Arroyo leading FPJ, 693,461 to 252,794. The only possible explanation was that the votes were taken mostly, if not entirely, from Pampanga.
This manipulation of public perceptions need not automatically affect the integrity of the entire data, if there were no attempt to change the same. But it is precisely part of the operation to alter the data. Once the trend is accepted, even the most militant would tend to drop their guard, and accept anything that follows, even if it was the result of invention or fraud.
The twin motu proprio orders of the Department of Justice and the Commission on Elections stopping the independent broadcast by ABC-Channel 5 of the results of elections, and the refusal by the pro-Arroyo newspapers to carry paid advertisements by the KNP containing hitherto unreported results of the elections, followed now by the Comelec order to the Daily Tribune not to carry the same ads – all these must be seen in this light. They are an integral part of the effort to steal the elections.
In the past, such attack on press freedom and the right of the people to be informed on matters of public concern would have ignited a rebellion in the ranks of the press. Not now. The mainstream media, both print and broadcast, have chosen to look the other way, while two of their own must fight for their freedoms. This shows the depth of the sinful collaboration between so many media owners and the administration. This has become the gravest danger to the democratic system.

Unelected and Illegal Government of Benigno Simeon "Noynoy" Cojuangco Aquino III

TODAY, June 30, marks the transition into power of all government officials elected during the recent May 10, 2010 automated elections. Many believe that these officials, including the President, Vice-President, and Senators were duly elected by the will of the people. Unfortunately, and no little thanks to the complicity and spin of many mainstream media establishments, this new set of local and national government officials were all illegally installed. They are the beneficiaries of a silent de facto civilian coup engineered by the country’s elitewho perpetuated massive fraud in the nation’s first automated elections.

This “electronic Garci” dwarfs the manual cheating done by Commission on Elections (Comelec) Commissioner “Garci” in the 2004 presidential elections. In effect, we now have a “new” government by virtue of corrupt operators who subverted our democracy. Consider the following.

Legal Violations of RA 9369 by Comelec

From the very beginning, Comelec, tasked by the Philippine Constitution to ensure clean and honest elections, did the very opposite of their mandate and responsibility. Comelec violated practically every major provision of Republic Act 9369, popularly known as the law mandating the use of an Automated Election System (AES).

Among others, Comelec violated the following provisions of RA 9369:

• No pre-testing of AES in Luzon, Visayas and Mindanao;
• No public examination of the source code to be used by the Precinct Count Optical Scanner (PCOS) machines;
• Dismantling of the PCOS UV security system;
• Removal of the Voter Verification feature; remember the infamous “congratulations” you got on the PCOS machine instead of a list verifying your vote?;
• Re-configuration of Compact Flash (CF) cards without proper oversight;
• No digital signatures (on Electronic Returns) as defined and required by RA 9369 and the Electronic Commerce Act;
• No clear inventory and accountability of millions of unused ballots;
• CF cards carried to canvassing center without security;
• Random Manual Audit (RMA) not done in the polling place and on the day itself and remained incomplete weeks after the elections;
• Hash codes in the Antipolo PCOS machines do not match published Comelec Hash Codes, showing that the Antipolo PCOS machines are illegal.

Highly Suspicious Activities

In addition, a few days before the elections, Comelec quietly sent out 20 CF cards and 2 “burners” to all provinces in the country, or a total 1600 CF cards and 160 “burners”. If one is computer literate and has access to the appropriate software, then this provision basically gives the necessary tools to operators to fraudulently tamper with election results, which they did. (See related discussion below.)

Despite warnings by the IT community, Comelec continuously assured the voting public that there will only be minimal problems with the electronic transmission of votes. Yet, on election day itself, there was a massive failure of transmission of votes, affecting more than 30% of all votes. The transmission failures gave political operators the opportunity to manually and electronically manufacture the votes.

Again, despite warnings by professionals and concerned citizens based on time and motion studies, Comelec assured the general public that there would be no delays in the voting. But during election day, there were very long lines. Many voters waited in line for hours in order to vote. But a significant number went home after experiencing delays lasting more than 6 hours. Five to eight million voters were disenfranchised in the process.

Even worst, because of transmission problems, Comelec lowered the threshold for canvassing of votes from 100% precinct returns, to sometimes, less than 70%. So even those who voted were disenfranchised because, in the end, their votes were not counted. And these figures do not include the highly problematic “null votes” numbering in the millions, votes that were also cast aside uncounted.

Common Pattern of Fraudulent Operations

Because Comelec dismantled key security features of the AES, political operators, including Comelec employees and Smartmatic technicians, were able to hijack the system and manufacture the “winners” of the May 2010 elections.

The House Committee on Suffrage and Electoral Reforms conducted investigations on the fraud committed during the recent elections. A significant number of candidates for congressmen, governor, and mayor testified in the Committee hearings. Significantly, their independent stories converged into a pattern of fraudulent operations that manufactured the “winners” of the recent elections.
• Candidates were offered victory at the polls. The offer presented precise numbers and percentages of voters who will vote for the candidate.
• The operators sold their illegal “services” for a price ranging from P10/vote to as high as P500/vote.
• When the candidates refused the offer, the operators offered the same package to the opponents of the candidates.
• Oftentimes, these opponents were not as popular as the candidates who refused the offer to cheat in their behalf. The opponents did not have large crowds in campaign rallies and did not campaign as much as the candidate. The opponents, certain of their “victory” also displayed arrogant and cocky behavior towards the candidate testifying in Congress.
• Yet their opponents win according to the predicted numbers and percentages.
• In one instance (candidate Ace Barbers), the political operator who approached him predicted, in November 2009,that a re-configuration of flash cards would occur before the elections. Barbers was incredulous until Smartmatic and Comelec announced on May 4 that they would re-configure 76,000 CF cards. When Barbers heard about this, he said in his testimony that he felt like cold water was poured all over his body and that he almost had a heart attack.

Modus Operandi of Fraud

The Committee hearings and other evidence revealed how the political operators manufactured the results of the May 2010 elections. Their method relied on:
• Pre-programmed Primary CF Cards
• Pre-shaded ballots
• Interception of Transmissions
• Collusion with Smartmatic Technicians and Comelec officials

Contrary to the repeated claims of Smartmatic technicians, the Primary CF cards can be programmed. During the congressional technical audit of the PCOS machines from Antipolo, the writer saw first hand how Smartmatic technicians, with the proper programs in the CF cards, could enable the PCOS machines to do all kinds of functions. As IT experts have observed in the YouTube upload, “Hacking Democracy”, if a CF card has a program inside together with voting data, then the CF card can be programmed to give the desired manufactured voting result. This is one reason why fraudulent political operators were so cocky about being able to engineer and predict the outcome of the elections.

But this was not all. Audit logs obtained from the Antipolo PCOS machines, that were found illegally stored in the house of a Smartmatic technician, showed people were voting at an average of 20 seconds per vote. What happened to all the highly visible long waiting times and long lines displayed by TV during election day? The evidence points to one person inserting pre-shaded ballots into the PCOS machines.

Even Congressman Teodoro Locsin, Chairman of the House Committee on Suffrage and Electoral Reforms, in his Committee Report, makes this observation as reported in the 29 June 2010 issue of the Daily Tribune:
Voting logged as taking place hours after the close of voting hours, with ballots logged as having been fed to the voting machine at a fast and unvarying rate consistent only with one person doing it, are not just suspicious but invalid as well.[Emphasis added.]

Another fingerprint of fraud is the mismatch between Smartmatic’s internal data and the transmission figures reported by TV stations on the evening of election day and newspapers the following day. On May 10, 2010, Comelec announced on 11:11pm, barely 4 hours after elections, that 57% or 21 million votes were already received from precincts all over the country. On the contrary, according to the congressional Committee testimony of the operations manager of LRA, which handled the secret Smartmatic National Data Center, their field technicians were reporting that only 20% of the precinct votes have come in.

Obviously the big question is why the huge difference between the two figures? Clearly an unknown data source was broadcasting fake election results into the central server of Comelec.

Conditioning/Reinforcing Factors

A number of mutually reinforcing factors made fraudulent election results convincing.

First fabricated surveys conditioned the mind of the public to expect certain candidates to win. Time and time again, this writer has been told by a number of people in different parts of the country that survey outfits, including Pulse Asia, did not include the writer’s name even when voters mentioned the writer as their preference for presidential candidate. Other presidential candidates had similar experiences with fraudulent surveys conducted by outfits, including Social Weather Station.

Media bias further reinforced the mind conditioning done by survey companies. Many mainstream media including ABS CBN, Philippine Daily Inquirer, Philippine Star, and to a lesser extent, GMA7 selectively covered the news, devoting lopsided airtime and newspaper space to candidates they preferred. And when the results of the elections came out, they brainwashed the public to believe not only that the election results were accurate and honest. They also incessantly repeated that the Philippines, by inference, had just achieved a world record, being the only country in the world to immediately transition from manual counting to electronic canvassing in one election. And when news of massive fraud was uncovered, these same media outlets either ignored the stories or gave the news an unacceptable slant.

Not to be left behind, the Parish Pastoral Council for Responsible Voting (PPCRV) became a de facto watchdog for Comelec instead of the voting public. Despite the massive evidence of fraud emerging at the local and national levels, PPCRV’s silence on the matter was defeaning.

Yes, there were political operators selling manufactured votes and corrupt politicians spending millions to buy their illegal services. And yes, Comelec had failed to do its regulatory duty and opened the floodgates for massive cheating. But, in the end, fraud would have not taken place at the massive scale that it did without the silent complicity of survey outfits, mainstream media, and the PPCRV.

Legal Transgressions of Congress

The one constitutional body, Congress, which could have stepped in to raise a red flag, did not question the massive fraud that pervaded the country’s first automated elections. Worse, Congress itself further aggravated the crime by engaging in its own fraudulent activities.

In violation of the Constitution, both the House of Representatives and the Senate did not convene a Joint Session to canvass the votes for president and vice-president. Instead they established a Joint Committee to canvass the votes and proclaim the winners of the presidential and vice-presidential elections. And, in a further violation of the law, specifically RA 9369, both Houses of Congress canvassed electoral returns that did not contain any digital signatures. Thus, Congress, together with Comelec, legitimized the election of national and local officials on the basis of election returns that did not contain digital signatures. Clearly both had violated the spirit and the letter of the law.

May 2010 Elections: Invalid and Void From the Beginning

If an election process wantonly violates the law, can one consider the election results valid? The obvious common sense and legal answer is a resounding “No!”. The recent national elections were void and invalid from the beginning. Therefore, the national and local officials who were “elected” by this fraudulent process cannot claim to be the authentic and legitimate beneficiaries of the “will” of the electorate.

Many are longing for a new beginning with the incoming government. Do not hold your breath. A new government conceived in fraud cannot become the center of a moral and systemic transformation that this country is longing for.

It is obvious that a moral and effective governance cannot arise on the basis of massive fraud. Citizens have to act now to challenge the new de facto civilian coup that the recent elections have placed in power.

Why The May 10, 2010 Philippine Polls Failed: The PCOS Forensics

ONE of several arguments that strongly point to systematic, nationwide fraud to favor a “secret candidate” of the Philippines’ preceding Illegitimate “President” Gloria Macapagal Arroyo is the fact that the recent automated elections despicably failed to meet the minimum standards for “transparent and credible” electoral process. Central to the questions on the integrity of the AES polls last May 10, 2010 are the Precinct Count Optical Scan or PCOS machines supplied by Venezuelan firm Smartmatic-TIM.
The PCOS is perhaps most infamous for Comelec’s admission at one point of the machines as having ascandalously high error rate ranging from 15-30 percent instead of the tolerable rate of a mere 0.005 percent. There have been a host of other PCOS issues, however, even several weeks prior to the elections. Mr. Roberto Verzola, the “Father of Philippine Email,” made a pre-electoral assessment of Comelec’s adopted technology and predicted a mere 25% success rate for the Southeast Asian country’s first automated elections. On the particular issue of the Smartmatic-TIM’s PCOS machines and what Comelec’’s relevant actions, he listed the following points of electoral insecurities:
* “no mention of full testing and acceptance by the Comelec: of the 82,200 PCOS machines delivered”
* disabling of what was the built-in PCOS feature of voter verification and confirmation feature
* amidst the PCOS’ use of two memory cards and purchase of extra memory cards, the potential risk of malicious capability for memory card substitution in 21.5 percent of the PCOS machines.
The Center for People Empowerment in Governance or CenPEG also made its assessment five weeks before the polls that the technology adopted by Comelec falls short of the minimum safety requirements, as well as industry standards that the law mandates. Strong evidence indicative of the grievous insecurities of the PCOS machines were exposed during the forensic investigation on the 60 PCOS machines found in the residence of a Smartmatic technician in Antipolo City.
It is most unfortunate that Senate President Juan Ponce Enrile did not wait for the final forensic report and pushed through with the proclamation of the supposed presidential and vice-presidential “winners” of the May 2010 elections. Nonetheless, the said report reveals the utter unreliability of the PCOS machines for any serious electoral exercise. Amidst the findings on the Susana compact flash (CF) cards, the report adds to the many evidences that seriously indicate HOCUS PCOS poll fraud during the last AES polls.
What follows is the encoding of the final report of the National Board of Canvasser's Joint Forensic team that investigated the PCOS machines suspiciously found in the residence of a Smartmatic technician (hardcopy provided by the office of Sen. Jamby Madrigal).

(Summary of Findings:)

Extracted Hash Code Did Not Match Published Hash Code.

The has code is an output of an algorithmic process that will verify if an electronic file is authentic or not. The hash code of an electronic file is always unique–it would change if the content of that electronic file is modified. The hash code is to an electronic file as the fingerprint or DNA is to humans. (p. 2)

Absence of Machine Digital Signatures.

Examination of the PCOS machines revealed that there was no evidence found to prove the existence of digital certificates in the PCOS machines, contrary to the claims of Smartmatic. (p. 3)

PCOS Machine Can Be Controlled Through Its Console Port.

The PCOS machine contains a console port, which Smartmatic claims is only a one-way out put port, used for diagnostic purposes only. The forensic team, with the allowance of Smartmatic technicians, was able to connect an ordinary laptop computer to the console port of a PCOS machine, via a serial cable provided by the latter.

“… the serially connected laptop computer was able to access the operating system of the PCOS machine… [without need for] username and password….
“The Linux operating system of the PCOS machine was exposed to full access and control….

“Smartmatic cannot offer a technical explanation for this major loophole” (pp. 3-4)
Hon.  Anne Susano’s CF Cards.

“The forensic team is of the opinion that the three (3) CF cards, one (1) of which is a main CF card, are all authentic CF cards, meaning that are all original and duly issued by Smartmatic or COMELEC.

“This finding would then belie the announcement of the COMELEC NCD Director that all the CF cards within Metro Manila had all been accounted for and turned over to the COMELEC.” (p.5).

Final Recommendations.

The Recommendations and Conclusions, as embodied in the Preliminary Report remain standing except for Item No. 1, which should now read, as follows:
“1.  To allow the forensic team to further explore the console port of the PCOS machine and perform tests as to its capabilities and vulnerabilities. For example, to allow the forensic team to store an executable code in the PCOS machine’s RAM disk and verify as to how the PCOS machine will behave with such a load in its RAM.”

It is further recommended that the forensic analysis of the PCOS machines be allowed and expanded by the incoming 15th Congress to include those PCOS machines which are subject of electoral protests and suspected of having been used as instruments of electoral fraud.

Importance of Digital Signature
Digital signature forms the lifeblood of authenticity in electronic transactions. It is a cryptographic process through which the Private Signature key of the sender is signed into a PRISM message, enabling the message's recipient, who has the correponding public key, to accurately authenticate the message. It serves to validate both data and identity to make sure that information has not been changed--in other words, not tampered--from the time it was created to the time it was sent to the time it reached the receiving party.
In all secured electronic transactions, including the critical election process, digital signatures constitute a fundamental infrastructure element for electronic voting. That the Comelec did away with it with its March 10, 2010 resolution--in violation of the Republic Act 9369 and its pledge before the Supreme Court in the Harry Roque - COMELEC-Smartmatic case--highlights how the 60 PCOS machines having been found in a Smartmatic technician's residence in the province of Antipolo have possibly been used to commit electoral fraud. As explained by Hermenegildo R. Estrella R. Estrella Jr., Management Systems Advisor for public and private consulting projects:
The purpose of the digital signature is for the receiving entity, in this case for example, the municipal or city board of canvassers, [to] know exactly where that particular vote count is coming from; and whether (1) it is authentic, (2) it can be verified, and (3) really accurate.
Had Comelec not dismantled the requirements for digital signatures, and had the third party certifying the authenticity of such signatures been independent (as required by law, should have mainly been the National Computer Center and NOT Smartmatic itself as is the case, constituting constitutes blatant conflict of interest), the discovery of the PCOS machines in a private residence should not have been an issue. This is because digital certification by the BOE inspectors would have allowed the PCOS machines to bear his or her identifying number no matter if s/he uses other PCOS machines as necessary in transmitting the electronic voting data, thus serving to verify the sender and help authenticate the transmitted election returns.
However, exactly because there was no digital security safeguard, who's to tell the machines were not used to transmit fraudulent votes? In fact, it is probable that the said PCOS machines, which obviously constitute part of the extra machines Comelec had ordered but found in apparently scandalous circumstances, were used in the unexplained transmission of ghost votes reported by the mainstream media on the night of election day. Jonathan Manalang, the Operations Director of the technical support center of Smartmatic, testified in Congress on how the media was astonishingly reporting 50 percent vote transmission when there was, in fact, only 20 percent votes yet being transmitted from the headquarters of Smartmatic-TIM.

Forensic Report of No Digital Certificates in PCOS
That the forensic report of the Congressional Canvassing body shows the ABSENCE of the machine version digital signature by itself glaringly reveals even more how highly anomalous the automated elections held last May 10, 2010 were. What, are the people supposed to believe that Comelec did not bother inspecting the delivered PCOS machines? Or, did the poll body even cared to test the capability of Smartmatic during the bidding (and post-bidding) process? Father of Philippine e-mail RobertoVerzola in fact made a March 2010 pre-electoral assessment that reports of how Comelec made no mention of having fully tested the delivered PCOS machines.
In the context of the discovery having been made amidst the lying claming of Smartmatic that (1) signature was present in the PCOS machines; (2) Comelec's bullying insistence that Smartmatic bag the P7.3-billion contract for AES; and (3) Comele's adamant claim that Smartmatic technology is unhackable, the revelation categorically points to collusion between the previous Arroyo administration, as represented by Comelec, and Smartmatic. These two entities apparently worked in conjunction with each other in paving the way for insecure, unsuccessful automated polls.

Hash Code
Hash codes are unique digital fingerprints that serve to authentically identify electronic files. That the hash codes extracted in six of the PCOS machines did not match Comelec-published results further adds to the fraudulent anomaly of the Philippines' first AES. One wonders whether there were other PCOS machines that carried hash codes not matching the ones published by Comelec?
That Comelec belatedly claims the extracted harsh code to be the correct one indicates incompetency on the part of the poll body at the very least and, more likely, deliberate fraud by the administration at its worst. Moreover, that the Philippine poll body apparently bothered not knowing the PCOS machines' genuine hash code until the fact of the incongruence of the extracted and of the Comelec-published hash codes was shown by the final report of the Congressional Canvassing body--which was released only on June 9, 2010 or nearly month after the polls--probably point to how the entire elections was intended to be fraudulent.
Why so? Because this incredible level of technical nonchalance by Comelec diametrically counters--and belies--Comelec's insistence that the security features of Smartmatic's PCOS machines are not hackable. Such diametrical opposition of fact versus Comelec pronouncement, amidst the poll body's illegal forfeiture of the digital security feature basic to any successful secured electronic process, only indicates systematic intent to deceive and con the Filipino electorate.

Forensic Discovery of Secret "Backdoor" Control
The discovery of the secret control "backdoor" in the console part of the PCOS machines is another grave issue that clearly points to Comelec-Smartmatic collusion for poll failure or automated poll fraud. Smartmatic having claimed the backdoor was merely a one-way output port for diagnostics when it could easily be exploited to fully manipulate the machine's actual operations through its sash interface loudly cries deception. That Comelec has been pronouncedly amiss in ensuring the security of the AES, among others, by certifying, and testing the PCOS machines, even when it has vouched for their supposed non-hackability, unquestionably show intent to deceive.

In sum, Congress' final forensic report of the PCOS machines inappropriately housed in the residence of a Smartmatic technician reveals the (1) mismatch between the Comelec-published and the extracted hash codes; (2) absence of digital certificates in the PCOS contrary to Smartmatic's claim; the (3) the alarming presence of a secret "backdoor" to easily control PCOS operations; and (4) even Comelec's inability to secure all its duly-issued CF cards. Amidst Comelec's move to forego of the digital security feature requirements of R.A. 9369, including that most fundamental digital signature; it's bullying insistence to acquire the services of Smartmatic; and highly suspicious failure to fully test the delivered PCOS machines while loudly vouching for them as supposedly being not hackable, the poll body in complicity with Smartmatic seemed to have plotted the failure of the Philippines' first automated elections. Beyond the failure in terms of a secured automated environment and authenticity of counted votes and election returns, it appears the previous Arroyo administration had ensured the victory of its secret anointed one HOCUS PCOS style.
